WARRANTY TERMS AND CONDITIONS
Subject to the exclusions and limitations below, Norstar Trailers LLC (hereinafter “Norstar”) warrants each new trailer Norstar manufactures under the Iron Bull brand (hereinafter “Product”) to be free from defects in material and workmanship, operated under normal use and service in the continental United States and Canada . The product warranted hereunder must be operated by the purchaser in accordance with practice approved by Norstar, with loads not exceeding the manufacturer’s rated capacities and subject to all terms and conditions of this Limited Warranty. The warranty start date begins at the date of retail purchase, or one year from the date the product was shipped from Norstar, whichever comes first.
During the Limited Warranty period, any defect in material and workmanship on any product not excluded below shall be repaired or replaced at Norstar’s option by a Norstar authorized representative or approved repair facility only. Norstar will pay for replacement parts and such approved shop labor in accordance with its labor reimbursement policy outlined below. Norstar reserves the right to supply remanufactured replacement parts as it deems appropriate. This Limited Warranty is your exclusive remedy, and applies to new Product only purchased in the United States and Canada which is accompanied by this written Limited Warranty and for which a completed warranty registration has been received by Norstar within 30 days after purchase of the Product.
WARRANTY COVERAGE
Three Year Structural Limited Warranty
Norstar warrants each new Iron Bull Trailer to be free from structural defects for a period of three (3) years from the warranty start date. Structural coverage by this warranty includes: the main frame, subframe, crossmembers, railings, and structural parts manufactured by Norstar.
Two-Year Comprehensive Limited Warranty
Norstar warrants each new Iron Bull Trailer to be free from defects in materials, components, and workmanship for a period of two (2) years from the warranty start date, subject to the conditions, limitations, and exclusions noted below.
a. Norstar warrants its paint finish against peeling, cracking, and to be consistent with industry standards for one (1) year from the warranty start date.
b. Norstar warrants all lumber to be consistent with the industry standards for Six (6) months from the warranty start date.
c. Components not manufactured by Norstar are the responsibility of the respective component manufacturers. Norstar will act responsibly to facilitate the repair or replacement of such parts by such component’s manufacturer's individual policy. Costs incurred by Norstar for repair or replacement parts or items not of Norstar’s manufacturing will be invoiced to you.
Parts Warranty
Parts replaced in the warranty period will be subject to the remaining balance of this two (2) year Limited Warranty, but the replacement parts will not in any way extend this Limited Warranty. Replacement parts after the warranty period shall be subject to Norstar’s current standard parts warranty. Part purchases made through the Norstar Parts Department are not covered under the Limited Warranty associated with a trailer purchase. A part purchased through the Parts Department shall only be covered by the warranty offered by the manufacturer of said parts.
Labor Reimbursement Policy
Norstar will, in its sole discretion, consider labor reimbursement during the defined warranty period, provided that the repair is pre-approved. Labor hours will be determined off Norstar’s Labor Reference Guide and reimbursed by Norstar's current flat rate or the dealer’s authorized contract rate. It is your responsibility to contact the Warranty Department to verify your labor rate. All warranty work must be pre-authorized by Norstar’s Warranty Department. Failure to do so will result in no warranty payment or replacement of parts.
Shipping Costs
Norstar will pay for the shipping of warranty parts by ground carrier. Expedited freight delivery is available at the expense of the owner. Shipping for the return of parts for warranty consideration will be at the owner’s expense, but will be reimbursed if the parts in question are deemed defective by Norstar or by the manufacturer of the part, and a legible copy of the invoice is provided.
Any claim or issue arising under this Limited Warranty must be reported immediately to an Authorized Norstar Dealer and will be handled within a reasonable time after the trailer is returned to an approved repair facility. Norstar will repair or replace, at its sole discretion, any parts or components found to be defective due to faulty materials or workmanship. NORSTAR’S SOLE OBLIGATION AND BUYER’S SOLE REMEDY UNDER THIS LIMITED WARRANTY IS REPAIR OR REPLACEMENT AT NORSTAR’S ELECTION.
All warranty repairs must be pre-authorized by Norstar in writing and are subject to commercially reasonable labor rates and material costs. All authorized warranty repairs must use factory-authorized replacement parts unless otherwise agreed by Norstar. Any defective part(s) must be sent by prepaid freight to Norstar in order to qualify for replacement or reimbursement under this Limited Warranty. Transportation costs to and from the approved repair facility and associated costs are not covered by this Limited Warranty and will not be reimbursed.
THE EXPRESS WARRANTIES SET FORTH HEREIN ARE THE EXCLUSIVE WARRANTIES OF NORSTAR, AND NO OTHER WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE, SHALL APPLY.
This Limited Warranty is not transferable and extends only to the first retail purchaser. If the product is transferred or sold by the first retail purchaser, the express warranties provided herein are void.
Exclusions:
A. Parts, components, or other items found to be altered or modified from their original condition without prior authorization of Norstar, including the installation of accessories, not made or installed by Norstar or an authorized representative or an approved repair facility, are excluded from coverage under this Limited Warranty.
B. Damages caused by negligence, accident, abuse, misuse, overload, corrosive materials, vehicle collision, failure to properly maintain the product, improper repair or installation, unsuitable storage, or catastrophic weather conditions are not covered by this Limited Warranty.
C. Wear items such as flooring, paint, brake linings, tires, struts, lights, batteries, hinges, bearings and hoses are not covered under this Limited Warranty for normal or expected wear and tear.
D. Damages sustained during delivery are not covered by this Limited Warranty. Delivery damages should be noted by the dealer at the time of delivery and reported. In order to file a shipping damage claim, damages must be indicated on the original packing slip and photos must be taken at the time of delivery. Failure to note on the packing slip and record photos of damage could result in a denied claim.
E. Cosmetic damage will not be covered if not reported by the dealer at the time of delivery. All cosmetic damages reported after first retail purchase will be denied.
F. Paint, decals, or any finish (collectively “finish”) not applied by Norstar are excluded from this limited warranty.
G. Any trailer used as a rental unit or as part of a rental unit is not covered by this Limited Warranty.
Limitations of Liability:
The remedies provided for in this Limited Warranty are exclusive, and the total liability of Norstar to any purchaser, whether based on contract, warranty, tort, strict liability or otherwise, shall not exceed the purchase price of the trailer giving rise to the claim.
IN NO EVENT, WHETHER BASED ON OR ARISING UNDER CONTRACT, WARRANTY, TORT, STRICT LIABILITY OR OTHERWISE, SHALL NORSTAR BE LIABLE TO PURCHASER OR ANY THIRD PARTY FOR SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND OR CHARACTER (INCLUDING, BUT NOT LIMITED TO, LOSS OF USE, REVENUE, PROFITS, OR WAGES, INVENTORY OR USE CHARGES, TOWING CHARGES, TRANSPORTATION OR SHIPPING COSTS, FUEL COSTS, LODGING OR MEALS, COST OF CAPITAL, AND CLAIMS BY CUSTOMERS).
Warrantable paint repairs are limited to spot repairs and blending consistent with industry standards. Deterioration due to use or exposure, such as chipping, scratching, fading, cracks in caulk seam, road salt, tar, other chemicals, pressure washing, or damage by animals will not be covered. Rust streaking originating from areas where it is virtually impossible to achieve total paint or powder coat coverage, i.e. behind rub rails or where two or more metals adjoin, are consistent with industry standards and are not covered by this Limited Warranty.
Applicable Law / Disputes:
The rights and obligations of the parties under this Limited Warranty shall be interpreted and governed in all respects in accordance with the laws of the State of Texas, USA, exclusive of any choice of law rules or provisions. Any dispute arising out of or related to this Limited Warranty which is not resolved by the parties informally shall be adjudicated exclusively in the courts of Lamar County, Texas, USA.
Severability / Waiver:
If any portion of this Limited Warranty is held to be invalid or unenforceable by a court of competent jurisdiction, such portion shall be deemed modified to the extent necessary to make it valid and enforceable; or if it cannot be so modified, then such portion shall be deemed severed from this Limited Warranty, with the remaining portions of this Limited Warranty continuing in full force and effect.
Norstar makes no other express or implied warranties beyond those described in this Limited Warranty.
